Professional Background Check under GDPR

The GDPR (General Data Protection Regulation) is a legal framework established by the European Union to protect the rights of individuals regarding the processing of their personal data. Implemented in 2018, it applies to all entities handling any personal data related to EU citizens or residents, whether within or outside the EU. Transferring data outside EU countries is prohibited unless compliant with the terms and conditions set forth in the regulation.

The regulation is based on a core principle that personal data processing must rely on the explicit consent of the data subject. Article 6(1)(a) of the GDPR includes that : processing of personal data shall be lawful only if there is explicit consent from the data subject for one or more specified purposes.

The GDPR guarantees individuals extensive rights, including the right to withdraw consent to data processing at any time (Article 7), the right to access and review their data (Article 15), the right to correct any data (Article 16), the right to request deletion of data in certain situations (Article 17), and the right to object to data processing in specific circumstances.
